Court Decision Creates Compensation Claims for Buy to Let Landlords -12 Jul 2009

A High Court decision involving London Estate Agents, Foxtons, has opened up the possiblity for landlords of buy to let properties to claim compensation for overly-inflated fees charged by agents. Foxtons charged customers 11 per cent commission when a tenant continued to occupy the property for longer than the initial term of the lease, and an additional 2.5 per cent commission if a tenant agreed to buy the property from the owner.  The OFT contended that these practices, among others, were unfair and the High Court agreed.  A key aspect of the case was the fact that the payment terms were not clearly disclosed.  Claims going back over 14 years will be accepted by the courts and it is hoped that the decision will lead to greater transparency in the letting and management terms provided by property agents.
